Default Gateway - clarification

I commented in another thread last week that the first Gateway was freeware--but had sort of a nagging feeling about it, so I e-mailed Bob Bates to get his take on it. This is what I received:

and Legend had the rights to distribute them only for a certain period. We
did do a limited promotion where it was free for a certain period of time,

So I wouldn't characterize the games as abandonware, but neither are they in
the public domain. If I can ever figure out the legal tanglings, I'll let

I apologize if I misled anyone; the bottom line is that Gateway is actually not in the public domain as I thought it was.
