It's not illegal as it clearly states what you are buying.

One person who retracted his bid had this to say:

Explanation: Seller changed the description of the item

I smell fraud ;)

Isn't this a violation of Microsoft's copyright? He's made a product and slapped MS copyrighted names on it and now he's trying to sell it.

The message clearly stated that it was just a box and, frankly, made it seem to me that it was just a really smart joke (and probably also to see who would be so stupid to vote for it), not some malicious con. Possibly both.

If he changed the description however and added this later, it's a different story. If not, there's no reason he should be banned. There are plenty of silly things on EBay, and plenty of inept fools that invest money in them.

Well, a blanket decision not to use it is also foolish ;). If you're sensible, you ask the right questions and you insist on genuine product photos it's highly unlikely that you'll get screwed.

When I see how many people with 0 feedback bid on the thing, it makes me wonder if there just a lot of eBay newbies out there desperate to buy their kids a 360 for Christmas, or if the seller had a bit of shilling going on...

It's certainly placed in a wrong category, and with so many people psyching out about 360 these days I reckon it was his intention to trick someone into buying it. The ban (or at least removing the auction) seems justified to me.

Oh dear. The guy that won it has bad feedback for not reading a previous item description properly. He really should've learnt his lesson! Although surely you can't put a picture up of something that's different to what you're selling?
