Game sealed with a round red tagged dot

I bought Tunguska, the Euro version 1.03, online.
When I received it, the game was sealed and had a round red dot tagged on it.
Does that mean the game is used?

and there isnt any paper manual, am I missing anything?

Why don't you ask the seller? How are we supposed to know what system they use to mark second hand or discounted items?

I bought it on eBay.
I was afraid that the seller would deny that the disc is second hand so just want to make sure before asking the seller.
